1. Scope: Why is TITAN not an NLP tool?

Deterministic Limitation: DCE is a deterministic verification engine for structured identifiers. It is NOT an Artificial Intelligence (AI) or Natural Language Processing (NLP) tool for name-redaction or semantic entity recognition. Failure of the engine to redact unstructured text or non-checksummed identifiers is outside the scope of this service.

2. Integration: What is the 'Gold Master' handover standard?

Deterministic Compliance Engine (DCE) is provided "as-is" for the purpose of identifying and redacting common PII patterns. While we aim for 100% accuracy, this tool should be used as part of a broader security strategy and not as a sole legal guarantee of compliance.

Integration Standard: The Customer assumes full responsibility for the correct integration, deployment, and operational use of the engine. The Official DCE Handover Guide constitutes the definitive technical standard for correct implementation. Any deviation from the Handover Guide constitutes a waiver of the Technical Warranty.

3. Licensing: How are metered calls settled?

Metered Model: DCE Australia operates on a recurring metered licensing model ($1.20 per API call). Access is provided on an infinite schedule following a successful procurement audit, with billing settlement occurring automatically via the Sovereign Master Agreement.

Delivery: Access is granted via an encrypted Sovereign Key. The "Asset Pack" (Source Code) is delivered separately to vetted institutional clients under a Master License Agreement.

4. Delivery: Why are all institutional sales final?

Due to the nature of the service (delivery of digital source code and intellectual property), all sales are final. We do not offer refunds, credits, or cancellations once the link to the Enterprise Asset Pack has been delivered. Customers are encouraged to review the technical specification and run the homepage demo to verify "Fitness for Purpose" before purchase.

5. Warranty: What is the deterministic liability cap?

Deterministic Warranty: DCE guarantees that any identifier passing the official ATO and Services Australia deterministic checksums (Mod11, Mod89, Mod10) will be successfully neutralized. Failure of the engine to fire on a valid checksum constitutes a breach of technical warranty.

Liability Ceiling: Subject to the statutory guarantees below, DCE Australia's total aggregate liability for any claim—including regulatory fines, data breaches, or technical failure—is strictly limited to the Aggregate Metered Value or the amount paid in the **ninety (90) days** preceding the claim, whichever is lower.

Exclusions: The liability cap above does not apply to loss or damage caused by DCE Australia's gross negligence, willful misconduct, or fraud.

6. ACL: How are consumer guarantees handled?

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable statutory rights or guarantees you may have under the ACL.

7. Resilience: What are the force majeure exclusions?

DCE Australia shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: Cloudflare edge network outages, global internet disruptions, sovereign state actions, or acts of God.

8. Jurisdiction: Why is NSW the governing jurisdiction?

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

The Titan V2 Terms of Service define the deterministic boundaries and institutional liability releases for the OMEGA engine. This agreement establishes a value-protection ceiling metered at $1.20 per call, ensuring clinical finality for 18+ checksummed identifiers while enforcing a zero-NPM supply chain security standard for institutional licensees.
